Giving Proper
Notice
When it is time
to part company with a Tenant, a Landlord must give proper notice. Many times
when notice is given it is due to the Tenant not paying their rent. In that
case, having an attorney give notice may be best. If the case goes to court, it
is much better to have the attorney stand there and guarantee notice. But you
can give it yourself to save some money.
When giving any notice the count
starts the day after the notice is given and weekends do count, but the last
day of the notice should not end on a weekend and would kick over to the next
business day.
The amount of
notice is very important. If a Tenant does not pay their rent, then a 3 day
notice to pay rent or quit is appropriate. If you just want to end a Tenancy,
then a 30 day notice should be appropriate unless anyone living in the home has
been there more then one year.
In my business of Property Management in Anaheim Ca. I find the best thing to do, is try and give as much
notice as possible. Be honest with the Tenant and give them as much time as you
can to find a new home.
Remember, you
must account for every dime spent from the security deposit and this accounting
must be done no later then 21 days after the Tenant moves out.
