Avoid Problems in the Screening Process
One of the most difficult things that a Landlord or Property
Manager does is screening for new Tenants. Not only is the process time
consuming, but is by no means full proof. The most important thing though, is to make
sure you follow the rule and have a specific plan when screening all Tenants
and treat everyone the same.
Just like all things, you should never judge a
book by its cover and you should never make a decision on Tenants by how they
appear. In any business I have been in, I find that it is impossible to know
anyone by how they appear and in the business of renting properties, the law is
very clear. DO NOT DISCRIMINATE.
In my business of Property Management in Orange County Ca. I
know that most people do not want to discriminate or think they are discriminating
against anyone, but sometimes it is hard to keep personal biases out of
decision making. But in this business you must and most of the time you will
find that you will be more successful at renting out your property if you stick
to the facts and the facts only.
One new law this year has to do with the new drivers licenses
being issued.
Assembly
Bill No. 60– After January 1, 2015, the Department of Motor Vehicles will
issue driver licenses to individuals who do not provide a social security
number on their application, but provide satisfactory proof that their presence
in the U.S. is authorized under federal law. Further, DMV may also issue a
license to an individual if they are unable to show proof of legal residence.
The applicant may sign an affidavit attesting they are ineligible for a SSN and
unable to show proof of legal residence. This applies to Landlords in that they
may not use the new license to deny a prospective tenant an apartment during
the screening process.
Again, in my
Business of Property Management in Anaheim Ca. I know most landlords and property managers do
not in their heart want to discriminate against anyone, so just understand the
law and you will be a much better manager.
