Entering a Tenants Property
Many people have the wrong information on when a Landlord or Property
Manager can enter a Tenants property and for what reason. When a Tenant signs a
lease that property is for their use for the duration of the lease as long as
they pay the rent on time and use the property for the purpose that is stated
in the lease. Often, in my business of Property Management in Orange County Ca.
I hear Tenants say that the Landlord can enter the property at will, but in
reality that is just not the case.
When a Landlord wants to enter a property, they have to have good
cause. As a Property Manager, I can only enter the property with proper notice
and also with a valid reason. If there is a repair that is needed, a 24 hour
notice is proper notice unless it is an emergency, then reasonable notice is
required. I never enter a Tenants property without them at home. Inspecting the
Smoke Alarms once per year is also required and another valid reason to enter
the property. Some Property Managers don’t like the smoke alarm inspection, but
it is a great legal way to enter the property and get a look inside.
The ability to show the property for rent or lease is also a valid way
to enter the property, but again proper notice is required and in this
situation it is also a good idea to give some kind of incentive to the Tenant
to cooperate with the showings. A Tenant has no incentive to cooperate with a Property
Manager when they want to show the property and a Manager has to be flexible with showing of the property. Entering the property with strangers without the Tenants at home is a huge risk. If something comes
up missing then there can be a problem. I always work with the Tenant and try
to limit the showings as much as I can.
When managing rental property, you need to be cognizant of how the
Tenant is going to react to someone entering their residence. I try and always
remember that this is their home, and when I ask to enter, I am a guest and I
act as such. People have a right to feel comfortable in their home and if a
Property Manager does not respect that, all kinds of problems can occur.

not just the law, but it is common courtesy and the more notice the better. I
always try and allow the Tenant to pick the best time that is convenient for
them, when I want to enter the property. This way they feel much more in
control and that makes them much more comfortable.
